About Visa Extensions
When you stay in the U.S. longer than your Visa has allowed, it is referred to as an overstay. All Visas have expiration dates which are shown on the I-94 Form. Visitors should have left the country before the expiration date. However, sometimes circumstances are such that you aren’t able to leave within the time period.
If you apply for an extension of stay or a change of status, you usually will be allowed to remain in the United States while the application is pending, even if your I-94 expires during the pending period.
While it may be tempting to do nothing or delay extending your Visa this is not recommended. Time is of the essence, and the process can be complicated and takes time. It’s important to submit your I-94 several months in advance of your Visa expiration date. Don’t wait to get the legal help you need.
Contact us to discuss the Visa extension process, answer your questions and if desired, help you be successful at legally remaining here in the country.
The 4 Consequences Of Overstaying Your U.S. Visa
- If you overstay your visa, you can be prevented from returning to the U.S. for at least 3 and as long as 10 years.
- Your visa will automatically be revoked if you overstay.
- Unlike prior to overstaying, typically you cannot get a new visa except in your country of nationality.
- Face additional restrictions and penalties.
How your Visa extension application and overall dealings with immigration are done can make the difference between success and failure. Why risk failure? If you cut corners or try to do it yourself and fail to get the extension will you by happy with yourself? Do it right. We’ve helped many others just like you navigate the complicated I-94 Visa Extension process so they can remain here in the US legally.
